The Final Statement

‘It is not a confrontation between power and the opposition. It is a struggle of Good against Evil. We are on the side of justice, truth, the state. I am happy to be involved in this struggle.’

Frankly speaking, I was pondering much if I should make my final speech at court. Since everything is obvious, what am I supposed to explain and to whom?! But a number of circumstances have urged me to speak out. This lawsuit is not a matter of chance for me.

My grandfathers were tried within fifteen minutes and gunned down having been granted no last word back in 1937. We came across similar repressions under Alievs later on. Being a citizen, someone engaged in politics and finally, a grandson to those very grandfathers, I cannot remain indifferent to what’s going on around. It is not a confrontation between power and the opposition. It is a struggle of Good against Evil. We are on the side of justice, truth, the state. I am happy to be involved in this struggle. I feel confident in the outcome of our struggle, common with my prison mates Intigam Aliev, Leila Yunus, Hadija Ismailova, Asif Yusifli, NIDA activists and other deserving people. As a matter of course there are two options: either to crawl or to go with our head held high. Crawlers are never honoured. We’ve opted for walking upright instead of crawling. Had I chosen otherwise, I would’ve felt less serenity than I feel now.

As one legend says, the body of the prophet Yakub is covered with ulcers, he is suffering but cannot find healing. He prays to God, ‘Oh Lord, I am a prophet – why am I suffering so severely?’ The God replies, ‘Thou hast not protected an oppressed man from the cruel ruler!’ Besides, it’s the court of conscience. My prison term doesn’t scare me, I don’t care about it in the slightest. I beg God only for a dignified life.

The Azerbaijan government promotes crime and drug abuse nowadays. The local prisons are drowning in blood. Three tonnes of heroin are exported from the country by an unknown owner and manufacturer… Nobody has been punished for that, whereas another poor man could be put in gaol for just one-tenth of a gramme of heroin. Many of those people have already fallen victim to this misfortune. Some other people face the threat of loss of life. How can I remain indifferent to it all? ‘Let everyone live as they wish, none of my business’, think the townsfolk. Such people care only about eating and breeding.

The process of the destruction of ethics and morality is underway in Azerbaijan. We fight against it. What have we done to be here? The answer is simple: we don’t want our children to be taught bribery at school, we want teachers to do their job, not falsify. We demand that pregnant women, sick and old people didn’t have to bow their heads at the door of foreign hospitals. That Azerbaijanis received their pensions timely and in amounts that none of them had to stand before someone with their head down. I involuntarily watch the Azerbaijani TV channels in prison. Thousands of people go out and ask for money for treatment on television. What are millions allocated to health care wasted on? This government spends millions on stones, walls, and marble, while people are dying due to lack of money. Despite all the wealth of Azerbaijan, there are neither doctors, nor teachers enough in this country. Why turn the country into a huge marble cemetery? People may think this power will rule forever. History proves that such regimes don’t last. There were many social systems like this in history. The peoples overcame them. Take European countries as an example. We are happy to have already covered most of the way. Power of the Alievs assassinated Elmar Gusseynov –

Judge: ‘What do you care about power? Speak of the accusation –’ Seymur Hazi: ‘Patience. I will speak of the accusation, too.’

Judge: ‘I have patience, but I warn you that if you don’t stick to the substance of the allegations –’ Seymur Hazi: ‘There is no one in Azerbaijan who could shut me up and interrupt my word.’

Judge: ‘I warn you.’ Seymur Hazi: ‘Throughout this trial, you have never called Meherrem Gasanov to appear [the one who had filed a suit against Seymur Hazi – editor], you have failed to carry out an investigation, haven’t taken any steps to expose the prosecution’s falsity, and now you urge me to speak about the allegations. If you deem the allegations baseless, so do I. I’ve already said that and I’m saying again that the fact you’re a woman is the reason for my behaving quite politely in this court. If they took the record of my last speech in pre-trial detention, if they don’t permit visits of close persons, if the hero of events in Cuba, Ehed Ibragimov, acts in my case as a public prosecutor, then it’s all clear enough. I don’t make up any intrigues even with my opponents, because their ideas, put next to ours, look miserable. If in Azerbaijan concrete evidence reveals that those who pass laws sit in their chairs thanks to millions in bribes, what laws are there to talk about at all?’

Judge: ‘Once again, I warn you. Speak of the accusation.’ Seymur Hazi: ‘We don’t kill mosquitoes, we drain the swamp. The government of Azerbaijan –’

Judge: ‘Don’t speak about the government, speak about yourself. We charge you not for your viewpoints and principles. We respect you and your convictions –’ Seymur Hazi: ‘Why are you speaking on behalf of the government? Why are you protecting them? If you represent the government instead of the state, that’s quite another matter –’

Judge: ‘What is being discussed is a particular case, not someone’s principles.’ Seymur Hazi: ‘May I converse about space, galaxies then?’

Judge: ‘No, you may not.’ Seymur Hazi: ‘It seems strange of you. Since Ilham Aliev has brought charge against me, who else am I supposed to speak about? Ilham Aliev is the initiator of this case. I have no personal dislike to him –’

Judge: ‘Ilham Aliev is the state leader of Azerbaijan who is worshipped by millions of Azerbaijani people around the world.’ Seymur Hazi: ‘I admire your taste. Besides, don’t speak on behalf of all Azerbaijanis and myself personally. As regards the allegations: Meherrem Gasanov neither knows me, nor has enmity with me. For what reasons and by what means was he dragged into this case? The Lord will punish those guilty of this. I regard him as a junior brother and forgive him [Here Meherrem Gasanov says: “Thank you very much, may Allah help you”, – noted by ed.] I expose the government in the “Azerbaijani Hour” programme and in the “Azadlyg” newspaper. That was the reason for my arrest. In 2011 I filed a lot of complaints against someone who had used torture on me in the temporary detention centre, and yet he has not been punished. I saw this man in the prison when Leila Yunus was arrested.

Power of Azerbaijan considers a thinking person not within the framework of equality before the law, but as a criminal. Prior to my arrest, after I had been kidnapped, I was required not to write about Ramiz Mehdiev. The last incident against me was organised on the authority of Ilham Aliev and by order of Ramiz Mehdiev. How come it hasn’t even been a few seconds since the incident, and the police were there already? The authority behind the scheme couldn’t tolerate my ideas. By doing so they made me silent. My friends wrote me from abroad, ‘Don’t come over, you’ll get arrested.’ I have come there anyway. Why would I get away from Azerbaijan? I’d expected getting busted. I wrote to Ramil Usubov they wouldn’t need to send men for following and arresting me. Call me and I’ll come myself.

Today we struggle for the right of everyone to live in calmness in Azerbaijan. They all have families, children. As if it’s only us who rose to fight the sword in our hands for the fate of all, have neither mothers, nor relatives, nothing to lose. I don’t expect justice from this trial. I wish all people lived in a country where they could sleep peacefully!

The final statement in original Azerbaijani

Biz isə sürünməyi yox, dik gəzməyi seçmişik. Əgər başqa yol seçsəydim, özümü indiki qədər rahat hiss eləyə bilməzdim. Bir hədis danışmaq istəyirəm: Yaqub Peyğəmbərin bədənini yara basır, o isə eləyir, çarəsi olmur.

Hakim: ‘Mən səbrliyəm, amma sizə xəbərdarlıq edirəm, ittihamdan danışmasanız…’
Seymur Həzi: ‘Azərbaycanda mənim ağzımı yumacaq, sözümü kəsə biləcək adam yoxdur.’
Hakim: ‘Mən sizi xəbərdar edirəm.’

Biz sizi fikirlərinizə, prinsiplərinizə görə ittiham etmirik. Sizə də, əqidənizə də hörmət edirik…’ Seymur Həzi: ‘Siz niyə hökumətin əvəzinədən danışırsınız, onları müdafiə edirsiniz? Siz dövləti yox, hökuməti təmsil edirsinizsə, o başqa məsələ…’

Hakim: ‘Biz kimlərinsə prinsiplərini yox, konkret hadisəni mühakimə edirik.’ Seymur Həzi: ‘Onda icazə verin, kosmosdan, qalaktikadan danışım…’

Hakim: ‘Yox, icazə vermirəm.’ Seymur Həzi: ‘Qəribə yanaşmanız var. Bu ittihamı mənə İlham Əliyev ünvanlayıbsa, mən kimdən danışmalıyam? Bu hadisənin təşkilatçısı İlham Əliyevdir. Mənim onunla şəxsi-qərəzim…’

Hakim: ‘İlham Əliyev Azərbaycan dövlətinin başçısıdır, bütün dünyadakı milyonlarla azərbaycanlının pərəstiş elədiyi adamdır.’ Seymur Həzi: Sizin zövqünüzə heyran qaldım. İkincisi, bütün azərbaycanlıların adından, şəxsən mənim adımdan danışmayın. İttihama gəlincə, Məhərrəm Həsənov nə məni tanıyır, nə mənimlə düşmənçiliyi var. Onu hansı səbəbdən, hansı şəraitdə bu işə bulaşdırıblarsa, Allah o adamların cəzasını verəcək. Mən ona kiçik qardaşım kimi yanaşıram və onu bağışlayıram [Büyrədə Məhərrəm Həsənov: “Çox sağ ol, Allah köməyin olsun”, — deyə Seymura təşəkkür edir. red]. Mən «Azərbaycan saatı» proqramında, «Azadlıq» qəzetində hökuməti ifşa edirəm. Həbsimin səbəbi də budur. Mənə 2011-ci ildə müvəqqəti saxlama təcridxanasında işgəncə vermiş adamla bağlı çoxsaylı şikayətlərim olmuşdu, amma onu cəzalandırmadılar. Həmin adamı mən Leyla Yunusun həbsində gördüm. Azərbaycan hakimiyyəti fikir adamına hüquq bərabərliyi çərçivəsində yox, cinayətkar kimi baxır. Hələ həbsimdən əvvəl oğurlandığım zaman məndən Ramiz Mehdiyevdən yazmamağı tələb etmişdilər. Mən isə gəldim. Azərbaycandan niyə qaçmalıyam? Mən həbsimi gözləyirdim. Ramil Usubova məktubumda da yazmışdım ki, məni həbs etmək üçün arxamca bir dəstə adamı töküb izlətməyə ehtiyac yoxdur. Çağırın, özüm gəlim. Bu gün biz Azərbaycanda hər kəsin rahatlığı uğrunda mübarizə aparırıq. Hamının ailəsi, uşağı var. Deyəsən, bir bizik ki, heç nəyimiz yoxdur, nə anamız var, nə qohum-əqrəbamız, qılıncımızı götürüb hamının taleyi uğrunda mübarizəyə qalxmışıq. Bu məhkəmədən heç bir ədalət gözləmirəm. Hamıya rahat yata biləcəyi bir ölkədə yaşamağı arzulayıram!
